DIGIPH FARE CARD
TERMS AND CONDITIONS
This DigiPH Fare Card Conditions of Use document is a contract between a DigiPH Fare Card holder and DigitalPH Asia Corporation (hereinafter referred to as the "Systems Provider"), effective upon your purchase of the DigiPH Fare Card.
TERMS USED IN THIS DOCUMENT ARE DEFINED AS FOLLOWS:

1.
“DigiPH” is the brand name of the Systems Provider.

2.
“DigiPH Fare Card” means a contactless smart card or any other form factor that may be issued by the Systems Provider as a payment instrument for transport operation.

3.
“DigiPH Application” means the stored value payment application licensed by Systems Provider, that allows passenger to make payments to any supported Transport operation. The Systems Provider shall be the issuer of and shall be responsible for the DigiPH
Application.

4.
“DigiPH Merchant” means a Transport vehicle, or kiosk authorized by DigiPH to accept and Top-up the DigiPH Fare Card as a form of payment for fare.

5.
“Co-Brander” means an entity or establishment with which the Systems Provider has a contract or arrangement for issuance of a Co-Branded Advertising DigiPH Fare Card.

6.
“Concessionary DigiPH Fare Card” means a DigiPH Card that has been registered for use by a Concessionary Person.

7.
“Concessionary Person” means a person who is eligible under Philippine law to avail of discounted fares in Transport Operators (such as Senior Citizens and Persons with Disabilities or PWDs).

8.
“Stored Value” means, at any given time, the monetary value stored in your DigiPH Fare Card.
A. DISTRIBUTION AND PURCHASE OF DIGIPH FARE CARD

1.
The DigiPH Fare Card can be purchased from any authorized DigiPH Card kiosks and distributors.

2.
The DigiPH Fare Card can be topped up at any designated loading station deployed by DigiPH and its clients, may it be onboard a transport unit, a separate kiosk, or a standalone loading machine that displays the DigiPH Logo.

3.
The DigiPH Fare Card can be used on any machine issued by DigiPH to its clients for fare collection.

4.
Your DigiPH Fare Card may be rejected in any of the following circumstances:

i.
It has expired or has been suspended or blocked e.g., your DigiPH Fare Card has been reported lost or stolen;
-
ii.
The remaining balance on the DigiPH Card is insufficient to cover the fare;
-
iii.
It has been suspected to be a counterfeit, illegally or fraudulently obtained, or suspected to have been stolen or tampered; or
-
iv.
It has been damaged or is malfunctioning.

5.
The Systems Provider shall not be responsible for the condition, quality or performance of the services purchased using your DigiPH Fare Card.
B. STORED VALUE BALANCE AND TOP-UP

1.
Your DigiPH Fare Card may have a minimum balance of zero pesos (₱0.00) and a maximum balance of Five Thousand Pesos (₱5,000).

2.
You may top-up your DigiPH Fare Card at any authorized top-up station that bears the DigiPH logo.

3.
The minimum top-up value is equivalent Twenty Pesos (₱20). The maximum top-up amount is Five Thousand Pesos (₱5,000).
C. RESPONSIBILITIES OF THE DIGIPH FARE CARD HOLDER

1.
You should take proper care of your DigiPH Fare Card to avoid damage (including but not limited to scratches, notches, tears, breaks, cuts, bends, drills or punctures) and shall not intentionally alter, deface, damage or destroy the same. You shall not
print, attach or place any marking or material onto the DigiPH Fare Card.

2.
You should not copy, duplicate, modify, and/or alter your DigiPH Fare Application or the DigiPH Fare Card including its firmware, software, program and/or data recorded in the electronic chip.

3.
You should cooperate with authorities during any investigation of possible crime, suspicious transactions, misrepresentations, fraudulent acts, and/or anomalies involving DigiPH Fare Card or the use thereof.

4.
You should be responsible for safeguarding your own DigiPH Fare Card against theft, damage, or loss. If you lose your DigiPH Fare Card, the balance will not be replaced.
D. DEFECTIVE OR DAMAGED DIGIPH FARE CARD

1.
In case your DigiPH Fare Card is malfunctioning due to a manufacturing defect, you may request it to be replaced with a new DigiPH Fare Card, provided the card was proven defective by the manufacturer, and subject to the following:

i.
The defective DigiPH Fare Card should be surrendered to the authorized DigiPH Card kiosk and/or distributor where it was purchased. The replacement DigiPH Fare Card shall be made available for pick-up within five (5) working days from your surrender of
the defective DigiPH Fare Card. The authorized DigiPH Card kiosk and/or distributor shall allow claiming of the replacement DigiPH Fare Card for a period of fifteen (15) calendar days (after the lapse of the five (5)-day period).

ii.
The foregoing notwithstanding, any defective Co-Branded Advertising DigiPH Fare Card should be returned to the Co-Brander who issued it. The replacement DigiPH Fare Card shall be available for pick-up from the Co-Brander within fifteen (15) working days
from your surrender of the defective Co-Branded Advertising DigiPH Fare Card.

iii.
The replacement card will contain any remaining balance from the defective card.

2.
In case your DigiPH Fare Card is not functioning due to misuse, you may purchase a replacement DigiPH Fare Card. Should you wish to transfer any remaining balance from your damaged or destroyed DigiPH Fare Card to your replacement DigiPH Fare Card, a
charge of fifty pesos (₱50) will apply for the balance transfer.
E. LOST OR STOLEN DIGIPH FARE CARD

1.
Please note that this Section applies only to registered DigiPH Fare Card. As a general requirement, the replacement of your lost or stolen registered DigiPH Fare Card shall require a valid proof of identity.

2.
If your Concessionary DigiPH Fare Card is lost or stolen, please proceed to any DigiPH accredited Transport Operator or authorized DigiPH Card kiosk and/or distributor to have your Concessionary DigiPH Fare Card blacklisted. Note: A government-issued
ID is required to adequately establish your identity. The lost or stolen Concessionary DigiPH Fare Card will be deactivated within twenty (24) hours from the time the Transport Operator or authorized DigiPH Card kiosk and/or
distributor receives your request for blacklisting within thirty-six (36) hours.

3.
Should you wish to transfer any remaining balance from your lost Concessionary DigiPH Fare Card to your replacement DigiPH Fare Card, a charge of fifty pesos (₱ 50) will apply.

4.
Only Concessionary DigiPH Fare Card are eligible for replacement and transfer of balance provided owners meet the requirements stipulated in item 2.

5.
The Systems Provider reserves the right to decline any request for blacklisting a Concessionary DigiPH Fare Card in case the identity of the cardholder cannot be established.

6.
If you find a DigiPH Fare Card, you should return it to the Transport Operator’s office or to any authorized DigiPH Card kiosk and/or distributor or mail it directly to DigiPH office at 8F Libran House 144 Legaspi St., Legaspi Village, Makati City, 1229.
F. VALIDITY OF DIGIPH FARE CARD

1.
The DigiPH Fare Card expires after four (4) years (from the date of registration), or when it reaches five thousand (5,000) transactions, whichever is earlier.

2.
An expired DigiPH Fare Card will not be able to top up.

3.
You can transfer the balance of your expired DigiPH Fare Card, up to six (6) months after expiry. A balance transfer fee of fifty (₱50) will be charged for this service.
G. LIMITATIONS ON LIABILITY

1.
The Systems Provider shall not be held liable for any misrepresentation, fraud, fault, or misconduct committed by any third party, such as but not limited to owners, employees, authorized representatives, and/or agents of DigiPH Fare Card Merchants, Transport
Operators, DigiPH Fare Card top-up providers, and distributors.

2.
The Systems Provider shall not be held liable for non-performance, error, interruption, or delay in the performance of our obligations under this Conditions of Use for causes not attributable to our fault or negligence, including:
-
i.
Flood, lightning, acts of God, fires, earthquakes, and other natural disasters;
-
ii.
Judgments, legislation, acts, orders, directives, policies, restrictions, regulations, prohibitions, or measures of any kind on the part of any court, governmental, legislative, and/or regulatory authority imposed or to be imposed after the fact;
-
iii.
Rally, protest, riot, terrorist activity, revolution, treason, coup d’etat, or similar acts;
-
iv.
Power failure;
-
v.
Acts or defaults of any telecommunications network operator;
-
vi.
Circumstances where communications lines and/or computer systems, and/or the DigiPH Fare Card Merchants, DigiPH Fare Card top-up providers and distributors cannot be used for reasons attributable to third party telecommunications carriers; and
-
vi.
Acts or omissions of persons, entities, or establishments for whom we are not responsible.
H. NEW SERVICES AND AMENDMENTS

1.
The Systems Provider reserves the right to provide new features, functions, and/or services for any type of DigiPH Fare Card, as well as to amend or change this Conditions of Use after due notice to holders DigiPH Fare Card.
